Miami Extradition Attorney

Extradition is the surrendering of one state to another or by one nation to another of an individual accused of a crime in the state or nation demanding the surrender of the accused. A state or nation makes an extradition demand in order to put the accused on trial within its jurisdiction. Extradition may only be sought if the United States has a valid Treaty between the requesting Country. The request by another Country begins the extradition process.

Unlike the legal process by which an individual faces when charged with a crime in the United States, the process for extraditing a person is much different for example, other than determining probable cause, a magistrate does not look to the specific facts of a case to determine guilt or innocence. Additionally, there is a presumption that a person facing extradition in not entitled to bond. This presumption, however, is rebuttable which is why it is imperative that you seek the advice of an experienced attorney at the very early stages of an extradition matter.
